1. Acceptance of terms
By accessing or using the Regulancy platform and website, you agree to be bound by these Terms of Service. If you do not agree, you may not use the services. These terms apply to all users, including account holders and their team members.
2. Description of service
Regulancy provides an AI-powered Wwft and AML compliance platform, including KYC/KYB verification, VIES and sanctions screening, dossier management, audit trails, human sign-off and training. We may modify, suspend or discontinue features at any time, with reasonable notice where possible.
3. Accounts and responsibilities
You are responsible for maintaining the confidentiality of your credentials, for all activity under your account, and for ensuring your team members comply with these terms. You must provide accurate information and keep it up to date. You must not share credentials or allow unauthorized access.
4. Acceptable use
You agree not to misuse the service: no unlawful, fraudulent or harmful activity; no attempts to breach security or access data you are not authorized to; no reverse engineering or scraping; and no use that violates applicable laws, including Wwft and AML regulations. We may suspend accounts that breach these terms.
5. Data and privacy
Your use of the service is also governed by our Privacy Policy, which describes how we collect and protect personal data. You are responsible for ensuring you have the legal basis to process the personal data of your clients through the platform.
6. Fees and payment
Certain features require a paid subscription or credits. Fees are billed as described at purchase. You are responsible for all charges incurred under your account. We may change pricing with reasonable notice; continued use after changes constitutes acceptance.
7. Intellectual property
Regulancy and its licensors retain all rights, title and interest in the platform, including software, design, trademarks and content. You receive a limited, non-exclusive, non-transferable license to use the service during your subscription. You retain ownership of your own data.
8. Limitation of liability
To the maximum extent permitted by law, Regulancy is not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or business. Our total liability is limited to the fees paid by you in the twelve months preceding the claim. The service is provided "as is" without warranties.
9. Termination
You may terminate your account at any time. We may suspend or terminate access for breach of these terms or for non-payment, with notice where reasonable. Upon termination, your right to use the service ends; data may be retained as required by law.
10. Governing law
These terms are governed by the laws of the Netherlands. Disputes shall be submitted to the competent courts in the Netherlands, without prejudice to mandatory consumer protections where applicable.
11. Changes to these terms
We may update these terms from time to time. We will notify you of material changes by posting the updated terms and, where appropriate, by email. Continued use after changes constitutes acceptance.
